Terms and Conditions

These are the terms and conditions ("Consumer Terms and Conditions") which govern your use of the web site to purchase a CUSTOMER Gift Voucher (the "Web Site").

1. Purchase

1.1 The Web Site offers Gift Vouchers for sale ("Gift Voucher"). 
1.2 No contract for the sale of any Gift Voucher will subsist between the Customer and easy-breaks.com, unless the order is confirmed by way of an email detailing that payment has been received in full, the content of the Gift Voucher purchased and confirmation of the Customer details (the "Confirmation"). That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated at the time easy-breaks.com sends the Confirmation via (whether or not that Confirmation is received). The Confirmation amounts to an acceptance by easy-breaks.com of the offer by the Customer to purchase a gift voucher. 
1.3 The Customer must check that the details of the Confirmation are correct as soon as possible and should print out and keep a copy of it. 
1.4 Payment shall be taken on our behalf by Sage Pay by credit or debit card, the type specified at the time of payment. 
1.5 The Customer undertakes that all details provided to easy-breaks.com for the purpose of ordering a Gift Voucher are correct, that the credit or debit card used is in the Customer name and that there are sufficient funds to cover the cost of the Gift Voucher ordered. 
1.6 In order to protect Customer details during ordering, easy-breaks.com uses a secure payment package known as Sage Pay. Security is indicated by a padlock which will appear in the bottom left hand corner of the web browser when Sage Pay has been accessed. 

2. Issuing Gift Vouchers

2.1 Each Gift Voucher sold is subject to terms and conditions of use which can be viewed on the Web Site alongside each individual Gift Voucher.
2.2 Gift Vouchers are valid for 1 year from the date of purchase and will not be extended beyond the date of expiration.
2.3 If you wish to have a printed Gift Voucher sent via post then please give us a call on 08430 55 44 33, 7 days a week, 9am – 9pm. There will be a charge of £3.50 per voucher to cover postage and administration costs.

3. Gift Voucher Redemption

3.1. Gift Vouchers can be redeemed by phoning 08430 55 44 33, 7 days a week, 9am – 9pm.
3.2. Gift Vouchers must be used in full in one transaction.
3.2. Gift Vouchers can be used for full or part payment of any easy-breaks.com break.
3.3. Gift Vouchers are non-refundable and non-transferable for cash.
3.4. Nothing in the Consumer Terms and Conditions or any additional terms and conditions applicable to a Gift Voucher alter or affect your statutory rights. 

4. Liability

4.1 In the event that easy-breaks.com breach their contract with the Customer, easy-breaks.com shall be responsible only for refunding the cost of the Gift Voucher. easy-breaks.com shall not be liable to pay any other compensation or losses suffered by the Customer as a consequence of easy-breaks.com’s breach of contract. 
4.2 easy-breaks.com agree to provide the services for which the Gift Voucher was purchased in accordance with the description on the Web Site, at all times with reasonable skill and care. easy-breaks.com make no other warranty or representation. 

5. Copyright

The Web Site is protected by copyright, and other intellectual property rights and laws. The Customer may view the Web Site and download part(s) of it to a personal computer for personal viewing for private purpose, but for no other purpose whatsoever. NONE OF THE CONTENT MAY BE DOWNLOADED, COPIED, REPRODUCED, TRANSMITTED, STORED, SOLD OR DISTRIBUTED FOR ANY NON PERSONAL PURPOSE WITHOUT OUR PRIOR WRITTEN CONSENT. 

6. Privacy

6.1 Customer privacy is important to us, and we are committed to maintaining the privacy of any personal information received from the Customer. By giving us your details you accept that we will be able to use them for operational purposes including providing your details to our payment collector Sage Pay. 
6.2 In using your personal data for operational purposes we may send you future offers within the easy-breaks.com Group.

7. Cookies

A cookie is a small data file that certain web sites write to your computer when you visit them. The only personal information a cookie can obtain is information a user supplies him or herself. A cookie cannot read data from your hard disk or read cookie files created by other sites. Please note that cookies can't harm your computer. Cookies, however, enhance our web site performance in a number of ways, including providing a secure way for us to verify your identity during your visit to our web site and personalising your experience on our site, making it more convenient for you.

9. Governing Law and Jurisdiction

The Web Site and these Consumer Terms and Conditions are governed by the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish courts in all matters relating to such use of the Web Site and in relation to these Consumer Terms and Conditions. If any provision of these Consumer Terms and Conditions is found by a court of competent jurisdiction to be invalid you agree that the other provisions of these Consumer Terms and Conditions will remain in full force and effect in so far as possible. If you access the Web Site from outside the UK you are responsible for compliance with any local laws relating to access.
